Terms of service

These terms apply when you buy a plan, a website or a care plan from Tech King LLC ("TechKing," "we," "us") on techkingllc.com or through a Stripe checkout or invoice. For custom projects, the signed service agreement and proposal take priority over these terms where they differ.

Monthly website plans

• What you get. We design, build, host and maintain your website for one fee. Your plan's page count, monthly edit time, reviews and support times are listed on the pricing page on the day you sign up.
• Billing. There is no setup fee. Your first payment is charged when you sign up, then on the same day each month (or each year on a yearly plan) to the card on file through Stripe.
• 12-month minimum. Plans have a 12-month minimum that starts on your sign-up date, including the time it takes to build your site. After that, your plan continues month to month.
• Yearly plans. A yearly plan covers the 12-month minimum up front. It renews for another year unless you cancel at least 30 days before the renewal date, and we email a reminder before it renews.
• Price changes. Your fee doesn't change during the minimum term. After that, we give at least 30 days' written notice of any change.
• Changing plans. You can move to a larger plan at any time; we quote any added pages and the new fee first. A move to a smaller plan takes effect after the minimum term.

Cancellations and refunds

• After the minimum term, you can cancel with 30 days' notice by emailing dhenderson@techkingllc.com or from your billing portal. Your site stays live until the end of the notice period.
• Before the minimum term ends, you can still cancel, but the remaining monthly fees for the 12 months are due, unless you buy out your site (below).
• Refunds. Monthly fees aren't refunded for partial months. Yearly fees aren't refunded for unused months. Where the law requires a refund, we follow the law.
• Care plans have a 3-month minimum counted from the first paid month, then continue month to month; either side can cancel with 30 days' written notice.

Who owns what

• You own your domain, content, logos, photos and data at all times, and your domain is registered in your name.
• On a monthly plan, we own the website design and code and give you the right to use them while your plan is active and paid.
• Buyout. You can buy your site's design and code at any time. The price is the pay-once price of your website, minus 50% of the plan fees you've paid, and never less than 25% of the pay-once price. We confirm the amount in writing; once it's paid, the plan ends and we hand over the files.
• On a pay-once website, you own the design and code once the final payment is made.

Failed payments

If a payment fails, Stripe retries it automatically and we email you. If it's still unpaid 14 days after the due date, we may pause your site and show a holding page until it's paid. If it's still unpaid after 30 days, we may end the plan, and the remaining fees for the minimum term stay due. Your content is never deleted while a site is paused.

When a plan ends

We take the site offline, give you an export of your content and images, and help point your domain to your new provider. Transfer help beyond one hour is billed at $125 per hour.

Pay-once websites and projects

Pay-once websites are billed as quoted: usually 50% to start and 50% at launch, before the site goes live. The One-Page Website can be bought outright at checkout. Hosting and care after launch are optional and billed separately.

Edits, support and extra work

• Included edit time is monthly and doesn't roll over. Work beyond it, or outside your plan, is billed at $125 per hour with your approval first.
• We reply to requests within your plan's support time on business days, and work on urgent issues, such as a site being down, as soon as reasonably possible. We don't guarantee uninterrupted service or a specific uptime.
• You're responsible for the content you give us and for having the right to use it.

Limits

We do our work with reasonable care and skill, but websites depend on outside services such as hosting, browsers and third-party tools. To the extent the law allows, our total liability for any claim is limited to the fees you paid us in the 3 months before the claim, and neither side is liable for indirect or lost-profit damages.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia.

Changes

We may update these terms. Changes apply to purchases made after the effective date above; your plan's price and minimum term stay as they were when you signed up.
